Introduction

When we say "Incubator List", "we", "our", or "us" in this document, we are referring to IncubatorList.com. When we say "Services", we mean any product created and maintained by IncubatorList.com, specifically our marketplace platform that connects startups with VCs, accelerators, and incubators.

By accessing our website or using our services, you agree to be bound by these Terms of Service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

Account Registration

When you register for an Incubator List account, you must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

You may register as either a startup seeking funding or as a program (VC, accelerator, or incubator) seeking startups. Each account type has specific features, permissions, and responsibilities as outlined in our platform.

Subscription and Payments

Incubator List offers various subscription plans with different features and pricing. By subscribing to a paid plan:

• You agree to pay all fees in accordance with the pricing and payment terms presented to you
• Payments are processed securely through Stripe and are made in USD
• Subscription periods may be monthly, yearly, or lifetime as specified during purchase
• Subscriptions automatically renew until canceled before the renewal date
• You are responsible for any applicable taxes
• No refunds will be issued for partial subscription periods
• We reserve the right to change subscription fees upon reasonable notice

Marketplace Rules

As a two-sided marketplace connecting startups with funding programs, we have specific rules to ensure fair and productive interactions:

For Startups:

• All information provided about your startup must be accurate and truthful
• You may not create multiple accounts to circumvent platform limitations
• You are responsible for the confidentiality of any materials you share with programs
• You may not use our platform to engage in fraudulent activities or misrepresent your business

For Programs (VCs, Accelerators, Incubators):

• Program profiles must accurately represent your organization's offerings and requirements
• You must handle startup information with appropriate confidentiality
• You may not use startup information for purposes other than evaluation for your program
• You must respond to applications within a reasonable timeframe

User Content

You retain ownership of any content you submit to our platform. By providing content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with providing our services.

You are solely responsible for the content you submit and must not violate any third-party rights or our content guidelines. We reserve the right to remove any content that violates these terms or that we find objectionable for any reason.

Prohibited Conduct

You agree not to:

• Use our services for any illegal or unauthorized purpose
• Violate any laws or regulations
• Infringe upon the rights of others, including intellectual property rights
• Attempt to gain unauthorized access to our systems or user accounts
• Engage in any activity that could damage, disable, or impair our services
• Use automated methods to scrape or collect data from our platform without our express permission
• Harass, abuse, or harm other users
• Post false, inaccurate, misleading, deceptive, defamatory, or libelous content
• Transmit any malware, viruses, or other harmful computer code
• Interfere with other users' enjoyment of the service

Intellectual Property

The materials on Incubator List's website, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, are owned by or licensed to Incubator List and are protected by copyright, trademark, and other intellectual property laws.

Permission is granted to temporarily download one copy of the materials for personal, non-commercial viewing only. This is the grant of a license, not a transfer of title, and under this license you may not modify or copy the materials.

Disclaimer of Warranties

The materials on Incubator List's website are provided on an 'as is' basis. Incubator List makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Further, Incubator List does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

Limitation of Liability

In no event shall Incubator List or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Incubator List's website, even if Incubator List or an authorized representative has been notified orally or in writing of the possibility of such damage.

This action may include - but is not limited to - the deletion of user data or other account details, suspension or termination of accounts, and legal action when necessary. Abuse may include any action which is illegal under applicable laws or any activity which we deem disruptive to our platform or harmful to other users.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Incubator List operates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
